This App is owned and operated by A1 Kisan Supply Private Limited, having its registered office at Door No .-12510, Plot No.42, Gowrav Gardens, R K Nagar, Anantapur, Andhra Pradesh, 515001. By signing up for a KisanSupply account or by using our KisanSupply services, you are agreeing to be bound by the following terms and conditions.

By visiting our App and accessing the information, resources, services, products, and tools we provide, you understand and agree to accept and adhere to the following terms and conditions as stated in this policy (hereafter referred to as 'User Agreement'), along with the terms and conditions as stated in our Privacy Policy (please refer to the Privacy Policy section below for more information).

We reserve the right to change this User Agreement from time to time without notice. You acknowledge and agree that it is your responsibility to review this User Agreement periodically to familiarize yourself with any modifications. Your continued use of this site after such modifications will constitute acknowledgment and agreement of the modified terms and conditions.

RESPONSIBLE USE AND CONDUCT:
1. In order to access our Services, you may be required to provide certain information about yourself (such as identification, email, phone number, contact details, etc.) as part of the registration process, or as part of your ability to use the Services. You agree that any information you provide will always be accurate, correct, and up to date.
2. You are responsible for maintaining the confidentiality of any login information associated with any account you use to access our Services. Accordingly, you are responsible for all activities that occur under your accounts.
3. Accessing (or attempting to access) any of our Services by any means other than through the means we provide, is strictly prohibited. You specifically agree not to access (or attempt to access) any of our Services through any automated, unethical or unconventional means.
4. Engaging in any activity that disrupts or interferes with our Services, including the servers and/or networks to which our Services are located or connected, is strictly prohibited.
5. You are solely responsible for any consequences, losses, or damages that we may directly or indirectly incur or suffer due to any unauthorized activities conducted by you, as explained above, and may incur criminal or civil liability.
6. We may provide various open communication tools on our KisanSupply, such as blog comments, blog posts, public chat, forums, message boards, newsgroups, product ratings and reviews, various social media services, etc. You understand that generally we do not pre-screen or monitor the content posted by users of these various communication tools, which means that if you choose to use these tools to submit any type of content to our KisanSupply, then it is your personal responsibility to use these tools in a responsible and ethical manner. By posting information or otherwise using any open communication tools as mentioned, you agree that you will not upload, post, share, or otherwise distribute any content that:
  1. Is illegal, threatening, defamatory, abusive, harassing, degrading, intimidating, fraudulent, deceptive, invasive, racist, or contains any type of suggestive, inappropriate, or explicit language;
  2. Infringes on any trademark, patent, trade secret, copyright, or other proprietary right of any party;
  3. Contains any type of unauthorized or unsolicited advertising;
  4. Impersonates any person or entity, including any KisanSupply employees or representatives.
7. We have the right at our sole discretion to remove any content that, we feel in our judgment does not comply with this User Agreement, along with any content that we feel is otherwise offensive, harmful, objectionable, inaccurate, or violates any Independent Partner copyrights or trademarks. We are not responsible for any delay or failure in removing such content. If you post content that we choose to remove, you hereby consent to such removal, and consent to waive any claim against us.
8. We do not assume any liability for any content posted by you or any other Independent Partner users of our KisanSupply. However, any content posted by you using any open communication tools on our website, provided that it doesn't violate or infringe on any Independent Partner copyrights or trademarks, becomes the property of A1 Kisan Supply Private Limited, and as such, gives us a perpetual, irrevocable, worldwide, royalty-free, exclusive license to reproduce, modify, adapt, translate, publish, publicly display and/or distribute as we see fit. This only refers and applies to content posted via open communication tools as described, and does not refer to information that is provided as part of the registration process, necessary in order to use our Services. All information provided as part of our registration process is covered by our Privacy Policy.
9. You agree to indemnify and hold harmless KisanSupply a digital property of A1 Kisan Supply Private Limited and its parent company and affiliates, and their directors, officers, managers, employees, donors, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of this User Agreement or the failure to fulfill any obligations relating to your account incurred by you or any other person using your account. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this User Agreement. In such an event, you shall provide us with such cooperation as is reasonably requested by us.
ACCOUNT TERMS:
1. To access and use the Services, you must register for a KisanSupply (“Account”). To complete your Account registration, you must provide us with your full legal name, business address, phone number, a valid email address, and any other information indicated as required. KisanSupply may reject your application for an Account, or cancel an existing Account, for any reason, at our sole discretion.
2. “Age Restrictions”. You must be the older of: (i) 16 years, or (ii) at least the age of majority in the jurisdiction where you reside and from which you use the Services to open an Account.
3. You confirm that you are receiving any Services provided by KisanSupply for the purposes of carrying on a business activity and not for any personal, household or family purpose.
4. You acknowledge that KisanSupply will use the mobile number or email address you provide on opening an Account or as updated by you from time to time as the primary method for communication with you (“Primary Communication Address”). You must monitor the Primary Communication Address you provide to KisanSupply and your Primary Communication Address must be capable of both sending and receiving messages. Your communications with KisanSupply can only be authenticated if they come from your Primary Communication Address.
5. You are responsible for keeping your password secure. KisanSupply cannot and will not be liable for any loss or damage from your failure to maintain the security of your Account and password.
6. Technical support in respect of the Services is only provided to KisanSupply Users. Questions about the Terms of Service should be sent to A1 Kisan Supply Private Limited for Support.
7. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Services, or access to the Services without the express written permission by KisanSupply.
8. You agree not to work around, bypass, or circumvent any of the technical limitations of the Services, use any tool to enable features or functionalities that are otherwise disabled in the Services, or decompile, disassemble or otherwise reverse engineer the Services.
9. You agree not to access the Services or monitor any material or information from the Services using any robot, spider, scraper, or other automated means.
10. You understand that your Materials may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. “Materials” means Your Trademarks, copyright content, any products or services you sell through the Services (including description and price), and any photos, images, videos, graphics, written content, audio files, code, information, or other data provided or made available
  by you or your affiliates to A1 Kisan Supply Private Limited or its affiliates.
  WHICH MEANS
  You are responsible for your Account, the Materials you upload to the KisanSupply Service and the operation of your KisanSupply Store. If you violate KisanSupply terms of service, we may cancel your service access. If we need to reach you, we will communicate via the Primary Email Address.
SERVICES BOOKING AND FINANCIAL TERMS:
1. KisanSupply allows users to order a product and upon acceptance of such orders by the KisanSupply (which are procured from the third party vendors/suppliers), the Company, subject to the terms and conditions set out herein, facilitates delivery of Services, or completion of tasks through the App.
2. KisanSupply procures the goods/products directly from the third party vendors and suppliers like from farmers and KisanSupply resell the procured goods/products on their App, This App is an online goods/products selling platform. We reserve the right not to disclose the suppliers’ details unless it is required by any competent law in due process of adjudication.
3. This App does not screen or censor the Users who register on and access the App. You assume all risks associated with dealing with other users with whom you come in contact through the App. You agree to use the App only for the lawful purposes without infringing the rights or restricting the use of this App by and third party.
4. All payments made against the Goods/Products on the App by the Users shall be compulsorily in Indian Rupees acceptable in the Republic of India. The App will not facilitate transactions with respect to any other form of currency with respect to the Goods/Products made on App. You can pay by (i) credit card or debit card or net banking; (ii) any other RBI approved payment method at the time of booking a Goods/Products; or
  (iii) credit or debit card or cash at the time of Goods/Products delivery. You understand, accept and agree that the payment facility provided by App is neither a banking nor financial service but is merely a facilitator providing an electronic, automated online electronic payment, receiving
  payment on Service delivery and remittance facility for the transactions on the App using the existing authorized banking infrastructure and credit card payment gateway networks. Further, by providing payment facility, KisanSupply is neither acting as trustees nor acting in a fiduciary capacity with respect to the transaction or the transaction price.
5. When you register for any kind of paid Services on this App, you agree to pay us the specific monetary amounts required for those Services. These monetary amounts will be described to you during the booking of the Services. The final amount required for payment for availing the Services will be shown to you immediately prior to final booking of Services. Payment for any ongoing Services is billed automatically until you notify Us that you would like to terminate your access to Services.
6. The prices reflected on the App, including packaging or handling charges, are determined solely by the KisanSupply. The prices are subject to change factoring in, but not limited to, prevailing market rates, transportation costs, employees’ costs. Very rarely, the prices may change at the time of placing Order but once a plan is purchased from the App, the cost of the plan and the quantity promised under the plan will not be changed until unless the validity of the plan is expired. changing the menu price without due intimation and such change of price are at the sole discretion of the KisanSupply attributing to various factors beyond control.
7. KisanSupply offers its products and services through Subscription based model wherein you as a consumer shall pay for the subscription and in lieu of this, shall receive the ordered products or service on the date of your choice, for the duration of your subscription. The prices and duration of the subscription shall be made available at the website or mobile app of KisanSupply which is subject to change at the sole discretion of KisanSupply.
8. KisanSupply supplies the orders from morning 5am to 8 am to the subscribers as KisanSupply is committed to supply fresh products to its consumers. However, if the consumer or subscriber is not available at the home, or does not pick up the phone call, then in such a situation, the order shall be automatically canceled by the KisanSupply as waiting for a particular consumer may cause delay in supply of the orders to other consumers.
9. If the subscribers are not available for a particular day, then it shall be the responsibility of the subscribers or consumers to inform KisanSupply on its App or website till the previous day regarding such unavailability to receive the orders from KisanSupply.
  
  Disclaimer: Prices on any Service(s) as reflected on the App may due to some technical issue, typographical error or product information supplied by Independent Partner be incorrectly reflected and in such an event Independent Partner may cancel Buyer’s Service booking(s).
AFFILIATE MARKETING AND ADVERTISING:
The Owner of the Company, through the App and its Services, may engage in affiliate marketing whereby the owner receives a commission on or percentage of the sale of Services on or through the App. The Owner may also accept advertising and sponsorship from commercial businesses or receive other forms of advertising compensation.
PRIVACY:
1. Through the use of our App KisanSupply and Services, you may provide us with certain information. By using the App or the Services, you authorize the owner to use your information in India and any other country where we may operate.
2. Your privacy is very important to us, which is why we've created a separate Privacy Policy in order to explain in detail how we collect, manage, process, secure, and store your private information. Our privacy policy is included under the scope of this User Agreement. To read our privacy policy in its entirety, please go through the privacy policy article.
LIMITATION OF WARRANTIES:
By using our KisanSupply, you understand and agree that all Services we provide are "as is" and "as available". This means that we do not represent or warrant to you that:
1. KisanSupply does not warrant that your use of Services will be Uninterrupted or Error-free, that KisanSupply will review the information and Services delivered through the App for accuracy or that it will preserve or maintain any such information or Services without loss.
2. KisanSupply shall not be liable for delays, interruptions, Service failure, or other problems inherent in use of the internet and electronic communications or other systems outside the reasonable control of KisanSupply.
3. KisanSupply supplies the products, which may be perishable with time, after buying the same from the third-party vendors and suppliers. KisanSupply checks the samples for quality assurance. The nature of the products is such that each and every product/item cannot be checked for quality and condition. Therefore, KisanSupply shall not be responsible if any specific item is dilapidated or perished with time. Hence, you shall not be entitled to claim refunds, if any such condition is found in the supply order.
4. KisanSupply does not guarantee the users that all the products under the subscribed plan/category (the term “category” hereinafter referred to the supra products like vegetables, leafy vegetables, herbs and spices, and the term “products” hereinafter referred to as Ladyfinger, brinjal, garlic, palak etc.) will be available at all the times, due to the supply, nature of the products, seasonality which are perishable and it will be not possible to maintain huge inventory all the times. Users understand that it is not possible to procure all the products at all the times. Users will only be able to place the order for the products which are in stock or available on the KisanSupply.
5. Products under catergories (the term “category” hereinafter referred to the supra products like vegetables, leafy vegetables, herbs and spices, and the term “products” hereinafter referred to as Ladyfinger, brinjal, garlic, palak etc.) may vary and they may not be the same as displayed at the time of consumer buying the subscription plan. KisanSupply shall make all good efforts to keep the products not vary frequently.
6. Due to the nature or their kind, certain products shall be considered in terms of the pieces only, their weight can be taken into consideration while conversing the quantity of the product into the grams at a present rate of conversion, i.e. one piece of cabbage can be taken as 500 grams and this will be done to calculate the whole or remaining quantity of the user. No users have the right to object or to raise any claim for this conversion rate.
LIMITATION OF LIABILITY AND INDEMNIFICATION:
In conjunction with the Limitation of Warranties as explained above, you expressly understand and agree that any claim against us shall be limited to the amount you paid, if any, for use of products and/or services. KisanSupply will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of using our Resources, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply.
COPYRIGHTS / TRADEMARKS:
1. All content and materials available on KisanSupply, including but not limited to text, graphics, app name, code, images and logos are the intellectual property of A1 Kisan Supply Private Limited, and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display or transmission of any content on this site is strictly prohibited, unless specifically authorized by A1 Kisan Supply Private Limited.
2. You must not use any part of the materials on the App Platform for commercial purposes without obtaining a license to do so from us or our licensors. If you print off, copy or download any part of the Platform in breach of these Terms of Use, your right to use the App will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
3. In order to make the App and the Services available to you, you hereby grant the Owner a royalty-free, non-exclusive, worldwide license to copy, display, use, broadcast, transmit and make derivative works of any content you upload or otherwise make available to the App. The Company claims no further proprietary rights in your content. If you feel that any of your Intellectual Property rights have been infringed or otherwise violated by the posting of information or media by another of Our users, please contact Us and let Us know.
TERMINATION OF USE:
1. You agree that we may, at our sole discretion, suspend or terminate your access to all or part of our App and Services with or without notice and for any reason, including, without limitation, breach of this User Agreement. Any suspected illegal, fraudulent or abusive activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities. Upon suspension or termination, your right to use the Services we provide will immediately cease, and we reserve the right to remove or delete any information that you may have on file with us, including any account or login information.
2. The KisanSupply specifically reserves the right to terminate these Terms of Services if You violate any of the terms outlined herein, including but not limited to, violating the Intellectual Property rights of the Owner or a third party, failing to comply with the applicable laws or other legal obligations, and/or publishing or distributing illegal material. If you have registered for an account with us, you may also terminate these Terms of Services at any time by contacting us and request termination. At the termination of these Terms of Services, any provisions that would be expected to survive termination by their nature shall remain in full force and effect.
GOVERNING LAW:
1. This App is controlled by A1 Kisan Supply Private Limited from our offices located in the state of Bengaluru, India. It can be accessed by most countries around the world. As each country has laws that may differ from those of Bengaluru, India by accessing our website, you agree that the statutes and laws of Bengaluru, India without regard to the conflict of laws and the United Nations Convention on the International Sales of Goods, will apply to all matters relating to the use of this website and the purchase of any products or services through this site.
2. Furthermore, any action to enforce this User Agreement shall be brought in the federal or state courts located in Bengaluru, India. You hereby agree to personal jurisdiction by such courts, and waive any jurisdictional, venue, or inconvenient forum objections to such courts.
SPAM POLICY:
You are strictly prohibited from using the App or any of the owner’s Services from illegal spam activities, including gathering email addresses and personal information from others or sending any mass commercial emails.
THIRD-PARTY LINKS & CONTENTS:
The Company may occasionally post links to third-party websites or other services. You agree that the Company is not responsible or liable for any loss or damage caused as a result of your Use of any third-party Services linked to from our App KisanSupply.
SHIPPING, CANCELLATION AND REFUND:
1. You agree to ensure payment for any services you may order from the App and you acknowledge and affirm that prices are subject to change. While ordering any Services, you agree to provide us with a valid email and shipping address, as well as valid billing information. We reserve the right to reject or cancel an order for any reason, including errors or omissions in the information you provide to us. If we do so after payment has been processed, we will issue a refund to you in the amount of the Purchase price. We also may request additional information from you prior to confirming a sale and we reserve the right to place any additional restrictions on the sale of any of our Services.
2. You agree to ensure payment for any items you may purchase from us and you acknowledge and affirm that prices are subject to change. For the sale of any Services, we may pre-authorize your credit or debit card at the time you place an order or we may simply charge your card upon shipment.
3. You agree that due to the nature of packaging of the goods there may be variation up to a certain gram in net weight of the order placed and delivered. We sincerely request the users to acknowledge this. KisanSuppy will only consider the requests of cases having any gross variations which is subjected to the sole discretion of KisanSupply.

GUARANTEE:
UNLESS OTHERWISE EXPRESSED, A1 KISAN SUPPLY PRIVATE LIMITED EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
FEEDBACK AND REVIEWS:
A1 Kisan Supply Private Limited welcomes any ideas and/or suggestions regarding improvements or additions to the Services. Under no circumstances will any disclosure of any idea, suggestion or related material or any review of the Services, Independent Partner Services (collectively, “Feedback") to KisanSupply be subject to any obligation of confidentiality or expectation of compensation. By submitting Feedback to KisanSupply (whether submitted directly to KisanSupply or posted on any KisanSupply hosted forum or page), you waive any and all rights in the Feedback and that KisanSupply is free to implement and use the Feedback if desired, as provided by you or as modified by KisanSupply, without obtaining permission or license from you or from any Independent Partner. Any reviews of an Independent Partner that you submit to KisanSupply must be accurate to the best of your knowledge, and must not be illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to Independent Partners or objectionable. KisanSupply reserves the right (but not the obligation) to remove or edit Feedback of Independent Partner Services, but does not regularly inspect posted Feedback.
WHICH MEANS
We welcome Users feedback but are under no obligation to ensure that ideas and suggestions regarding our Services or the services of Independent Partners remain confidential and we can use the feedback in any way we want.
MODIFICATIONS AND VARIATIONS:
1. We reserve the right, in our sole and absolute discretion, to update or change any portion of the Terms of Service at any time. We will provide
  you with reasonable advance notice of changes to the Terms of Service that materially adversely affect your use of the Services or your rights under the Terms of Service by sending an email to the Primary Email Address, providing notice through the KisanSupply administrative console, or by similar means. However, KisanSupply may make changes that materially adversely affect your use of the Services or your rights under the Terms of Service at any time and with immediate effect (i) for legal, regulatory, fraud and abuse prevention, or security reasons; or (ii) to restrict products or activities that we deem unsafe, inappropriate, or offensive. Unless we indicate otherwise in our notice (if applicable), any changes to the Terms of Service will be effective immediately upon posting of such updated terms at this location. Your continued access to or use of the Services after we provide such notice, if applicable, or after we post such updated terms, constitutes your acceptance of the changes and consent to be bound by the Terms of Service as amended. If you do not agree to the amended Terms of Service, you must stop accessing and using the Services.
2. KisanSupply may change the Fees for the Services from time-to-time. We will provide you with 30 days’ advance notice prior to any changes in Fees by sending an email to the Primary Communication Address, providing notice through the KisanSupply administrative console, or by similar means. KisanSupply will not be liable to you or to any Independent Partner for any modification, price change, suspension or discontinuance of the Services (or any part thereof).
  WHICH MEANS
  If we make a change to the Terms of Service that adversely affects your rights under the Terms of Service or your use of our Services in a material way, we will notify you in advance (unless the change relates to legal requirements or to prevent abuse of our Services, among other things).
